I-4-0-4.Operating Branch and Court Case Preparation and Review Branch (CCPRB) Functions and Responsibilities

The staff in the operating branches (DPBs and RSI/SSI Branch) and the CCPRBs provide professional and technical advice to the Associate Commissioner, the Executive Director of OAO, the AAJs, and other OHA officials in litigated cases, as generally explained in I-4-0-2.
In new court cases, the staff in the CCPRBs may recommend to defend on the record or to seek remand, depending on whether further administrative action is warranted and good cause for remand exists.
The staff prepares certifications of the administrative records (CARs) in litigated cases for the CCPRB Chief's signature. They also prepare affidavits and declarations which are used to support motions for dismissal.
The staff in the operating branches analyze and recommend action on cases referred by the OGC for consideration of whether the Commissioner should request voluntary remand on his/her motion.
The staff in the operating branches and in the CCPRBs analyze and recommend action on cases remanded by the courts. They prepare remand orders and related correspondence on behalf of the OAO Executive Director and other AAJs. As necessary, they prepare comprehensive decisions for the Executive Director and other AAJs in civil action cases.
The staff in the operating branches and in the CCPRBs analyze and recommend action on final and recommended ALJ decisions on court remand cases. They prepare notices declining to assume jurisdiction and related correspondence on behalf of the OAO Executive Director and other AAJs. As necessary, they also prepare notices assuming jurisdiction of cases and either prepare decisions or remand orders for the OAO Executive Director or other AAJs.
