Subject: Initial Processing of a Request for Hearing

Background

This transmittal amends chapter I-2-0 of the Hearings, Appeals and Litigation Law (HALLEX) manual to add a new section I-2-0-8 entitled “Accommodations Under Section 504 of the Rehabilitation Act of 1973.” This section provides background information on the applicability of Section 504 and sets forth the procedures for responding to requests for accommodations at the hearing level.

Explanation of Content and Changes

HALLEX I-2-0-8 A – We titled the subsection “Background” and describe Section 504, its applicability, and its relationship to the Americans with Disabilities Act.

HALLEX I-2-0-8 B – We titled the subsection “Accommodations” and describe the accommodations an individual can request under Section 504.

HALLEX I-2-0-8 C – We titled the subsection “Documenting Accommodation Requests” and describe the procedures hearing office staff will follow when an accommodation request is received pursuant to Section 504.

HALLEX I-2-0-8 D – We titled the subsection “HO Considerations” and explain how accommodation requests under Section 504 affect case workup and scheduling of hearings.

HALLEX I-2-0-8 E – We titled the subsection “Filing a Complaint.” This subsection describes an individual's right to file a discrimination complaint and provides information about how to file a complaint.
