Background

This transmittal amends the Hearings, Appeals and Litigation Law (HALLEX) manual Chapter I-3-7 to clarify how the Appeals Council will handle remands involving a claimant's or other party's right to benefit continuation. These revisions were necessary due to systems and business process changes.

Explanation of Content and Changes

We added subsections and subsection headings throughout HALLEX I-3-7-40 and also made the following changes:

I-3-7-40 B Note 1 – We added language to the existing note to indicate that the Appeals Council will include a notation in the certified electronic folder about benefit continuation cases and clarified an e-Sign workaround for title XVI and concurrent title II and XVI cases.

I-3-7-40 B Note 2 – We added a new note to clarify how, in title II only cessation cases, the Appeals Council will notify hearing offices of potential payment continuation in electronic and paper cases.
