Subject: Court Remands

Background

It was discovered in the clearance stage for the new exhibit at I-3-8-90 that information concerning the routing of Title XVI favorable Appeals Council decisions was incorrect. The incorrect information provided that such cases, within the jurisdiction of Region IV, should be forwarded to the Southeastern Program Service Center. We determined that, in fact, all Title XVI favorable Appeals Council decisions should be forwarded to the servicing Social Security Office for effectuation. There is no special routing for Region IV Title XVI favorable decisions. HALLEX I-4-3-116 contains the same incorrect information.

Explanation of Content and Changes

This transmittal revises I-4-3-116 to provide that all Title XVI favorable Appeals Council decisions should be routed to the servicing Social Security Office for effectuation. Information concerning separate routing procedures for Region IV cases has been deleted.
