Subject: Processing of ALJ Decision After Court Remand

Background

This transmittal amends section I-4-4-13 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for the Office of Appellate Operations when a claimant files timely exceptions to an administrative law judge decision issued after court remand. We made significant formatting and editorial changes throughout the section.

Explanation of Content and Changes

Section I-4-4-13 is retitled “Office of Appellate Operations (OAO) Actions When Claimant Files Timely Exceptions” and is revised as follows:

I-4-4-13 A – We changed the title to “General” and added an explanation of when the instructions apply. We updated processing instructions regarding the staff that handles exception requests and made other minor editorial changes.

I-4-4-13 B – We changed the title to “Recommendation to Issue a Decision or Remand Order” and made formatting changes for consistency with other HALLEX sections. We removed outdated information and updated the instructions consistent with current procedures.

I-4-4-13 C – We changed the title to “Recommendation to Decline Jurisdiction” and made formatting changes for consistency with other HALLEX sections. We removed outdated information and updated the instructions consistent with current procedures.
