Subject: Administrative Law Judge Decision After Court Remand
This transmittal amends section I-4-8-5 of the Hearings, Appeals and Litigation Law (HALLEX) manual and archives section I-4-8-65 of the HALLEX manual to update our policies and instructions concerning how the Office of Appellate Operations' (OAO) Division of Civil Actions (DCA) handles district court litigation.
I-4-8-5 – We removed references regarding the authority to issue final decisions after court remand prior to September 1989, and we clarified that the authority to issue final decisions after court remands is set forth in 20 CFR 404.984 and 416.1484.
I-4-8-65 – We archived this section, as the information regarding recording audit requirements is available in HALLEX I-3-2-8. The instructions in I-3-2-8 will be updated at a later date to reflect all of the audit requirements for OAO staff.
