Subject: Appeals Council Interpretations

Background

In the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (MMA), Congress mandated that SSA transfer its responsibility for adjudicating Medicare appeals to the Department of Health and Human Services (HHS) between July 1, 2005 and October 1, 2005.

Explanation of Content and Changes

This transmittal updates Chapter II-5-0-1 (Introduction to the Appeals Council Interpretations (ACIs)) to reflect that due to the transfer of Medicare appeals to HHS, subdivision II-5-4 of the Appeals Council Interpretations (Health Care Financing Administration (HCFA) Matters) is being removed. Currently there is only one ACI in this subdivision, II-5-4-1 (Post-Reconsideration Rationale in Title XI and Title XVIII Cases), issued July 11, 1990. This ACI is outdated and has served its intended purpose and is hereby deleted.

This transmittal also includes several editorial revisions to II-5-0-1, including the deletion of the section VII (Index of Appeals Council Interpretations). Volume II, Part 5 no longer has an index to the ACIs.
