422.1 Who is considered a "parent" for Social Security purposes?

You are considered the parent of the insured worker if, under applicable State law, it is found that you have the status of parent with respect to the taking of intestate personal property at the time of the insured worker's death.

422.2 What does under "applicable State law" mean?

Applicable State law is either:

  1. The law applied by the courts of the State where the insured worker was domiciled at the time he or she died; or

  2. The law applied by the District of Columbia if the insured worker was not domiciled in any State at the time of his or her death.
