1837.Conviction for Subversive Activities

1837.1How does the conviction of subversive activities affect your benefits?

If you are convicted of subversive activities, you may lose the right to Social Security benefits if you are convicted of an offense:

  1. Under title 18 of the United States Code, chapter 37 (relating to espionage and censorship), chapter 105 (relating to sabotage), or chapter 115 (relating to treason, sedition, and subversive activities); or

  2. Under section 4 of the Internal Security Act of 1950, as amended (relating to subversive activities).

1837.2Can additional penalties be imposed?

Upon conviction of one of these offenses, the judge may impose an additional penalty that affects your right to monthly Social Security benefits. It does not matter whether the benefit is payable on your own or on anyone else's Social Security earnings record.
