I-4-3-15.Declarations — Res Judicata

There is no right to judicial review when a claimant receives a res judicata dismissal order from either an administrative law judge or the Appeals Council. When the claimant files a civil action in a res judicata dismissal, the analyst will review the file to ensure the adjudicator(s) properly applied the res judicata provisions. In addition, the analyst will verify the date last insured to ensure that there is not an un-adjudicated time period (see Hearings, Appeals and Litigation Law manual I-3-3-9).

Unless a remand is warranted, the analyst will prepare a declaration using the appropriate template in the Document Generation System.
