I-4-5-30.Releasing the Supplemental Review or Request for Voluntary Remand Response

A. General

Generally, the Court Case Preparation and Review Branch (CCPRB) support staff handles a case after a supplemental review has been completed. When required, the CCPRB support staff will:

  • Separate and date stamp all copies of the memorandum.

  • Fax or e-mail the request for voluntary remand (RVR) memorandum response to the appropriate Office of the General Counsel (OGC).

  • Include a copy in the claim(s) file.

  • Include an additional copy of the memorandum and the original copy of any additional evidence, or other documents in the claim(s) file.

  • Make an appropriate entry into the Appeals Review Processing System (ARPS) to reflect the action taken and the date.

B. Continued Defense

The support staff will read the memorandum to determine whether remand is being requested. If the memorandum does not request remand, the claim(s) file or certified administrative record will remain in the branch because OGC may request further consideration of the case under the reconsideration RVR procedures (see Hearings, Appeals and Litigation Law manual I-4-5-20).

C. Memorandum Requesting Remand

If the memorandum requests remand of a pending court case, the support staff will make an entry into ARPS to reflect that a court order of remand is expected, close the ARPS entry, and, if paper, file the case among the other cases awaiting copies of court remand orders.
