I-4-6-45.Special Procedures for Delayed Cases

Last Update: 08/22/16 (Transmittal I-4-56)

A court remand which the Office of Appellate Operations (OAO) will not release within 125 days from the date of the court order, regardless of the date of receipt, is a delayed case and will receive priority handling.

When the analyst completes the case action on a delayed remand order and the case is ready for release, the support staff may telephone the hearing office (HO) and inform the group supervisor, or the Hearing Office Director, that OAO is forwarding a delayed remand order to the HO. The analyst will give the case to a support staff for immediate release.
