Subject: Representative Fees
This transmittal amends chapter I-1-2 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update and clarify instructions related to adjudicators obtaining information on the fee amount under the fee agreement process.
I-1-2-25 – We renamed subsection B to “When to Take an Action on a Fee Agreement” and moved the information to new sub-subsection 1, “Action on Fee Agreement” except Note 2. We moved Note 2 to new sub-subsection 2, “No Action Required on Fee Agreement,” and we renumbered Note 3 as Note 2. We also updated the language formerly in Note 2 for clarity. In subsections C and D, we updated the language for clarity. We moved and revised the language concerning support staff actions to HALLEX I-1-2-45. We also made minor editorial changes throughout this section.
I-1-2-45 – We deleted the NOTE and moved its content to a new second paragraph. We revised the content to include language that corresponds with the proposed language in HALLEX I-1-2-25 C, concerning adjudicators receiving information about the fee amount and language regarding support staff actions, as a new third paragraph. We also updated the language for clarity and made editorial changes throughout.
