Subject: Fraud, Similar Fault, Criminal Violations, and Referrals from OIG

Background

This transmittal adds section I-1-3-30 to the Hearings, Appeals and Litigation Law manual to incorporate instructions for referring excluded medical sources of evidence for failure to comply with 20 CFR 404.1503b and 416.903b.

Explanation of Content and Changes

I-1-3-30 – We titled the section “Referring Non-Compliant Excluded Medical Sources of Evidence to the Office of the Inspector General.” In this section, we provided guidance on how to refer an excluded medical source of evidence who has not included a written statement of exclusion with evidence the source furnished either directly or indirectly through a claimant, representative, or other individual or entity. We added a NOTE explaining that a referral will not delay case processing or adjudication unless otherwise instructed by the Office of the Inspector General (OIG). We also included a cross reference to the Program Operations Manual System for the steps to follow when reporting the source to OIG using the SSA-e8551 Fraud Entry Form.
