Subject: Prehearing Analysis and Case Workup

Background

This transmittal amends section I-2-1-30 of the Hearings, Appeals and Litigation Law (HALLEX) manual to clarify our instructions regarding the professional qualifications of State agency consultants.

Explanation of Content and Changes

In addition to minor editorial changes, HALLEX I-2-1-30 was updated as follows:

I-2-1-30 A – We clarified in NOTE 2 that hearing office staff may also request that a medical expert provide a written resume. We added NOTE 3 to clarify that an administrative law judge is not required to admit into the record a written statement of the qualifications of a State agency medical or psychological consultant. We provided references to the regulations and Program Operations Manual System instructions that explain how the Disability Determination Services qualify State agency consultants.
