Subject: Issues Before the Administrative Law Judge
This transmittal amends chapter I-2-2 of the Hearings, Appeals and Litigation Law manual to update procedures regarding issues before an administrative law judge (ALJ).
Chapter I-2-2 is amended as follows:
I-2-2-1 – We removed unnecessary citations, definitions, and subheadings. We reformatted the information and made editorial changes.
I-2-2-10 – We reorganized the information under three new subsections titled “General,” “Issues Previously Decided in Claimant's Favor,” and “New Issues.” We also made editorial changes throughout the section.
I-2-2-22 – We added a section titled “Escalated Claim(s) — Common Issue” to provide instruction regarding when an ALJ will accept an escalated claim at the hearing level. We also provided instructions on when and how the ALJ will provide the claimant notice of an escalated claim.
