Subject: Conduct of Hearings

Background

This transmittal amends chapter I-2-6 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions relating to adducing the evidence, admitting evidence into the record, and continued or supplemental hearings.

Explanation of Content and Changes

Chapter I-2-6 is amended as follows:

I-2-6-56 – We made several editorial and formatting changes throughout the section, including removing outdated and unnecessary language. We moved instructions related to admitting evidence into the record to HALLEX I-2-6-58 as the information was directly related to issues addressed in that section.

I-2-6-58 – We incorporated instructions in subsection A that were previously in HALLEX I-2-6-56. The instructions set forth actions an administrative law judge will take if he or she does not admit information into the record. We made other minor formatting and editorial changes throughout the section.
