Subject: Obtaining Evidence
This transmittal amends section I-2-5-82 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions for noncompliance with a subpoena.
We updated HALLEX I-2-5-82 by making editorial and formatting changes, and removed all subsections. Additionally, we clarified that an administrative law judge will adjudicate a claim without the information requested in a subpoena if the Office of the General Counsel declines to seek a court order to enforce a subpoena or the court denies a motion to compel compliance with a subpoena.
