Subject: Conduct of Hearings

Background

This transmittal amends chapter I-2-6 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information about the conduct of hearings, including introductions, oaths and affirmations, and oral arguments at the hearing.

Explanation of Content and Changes

HALLEX I-2-6 is amended as follows:

I-2-6-50 – We removed unnecessary language and made several editorial and formatting changes to the section to improve readability. We also added several helpful citations to the regulations or other HALLEX sections.

I-2-6-54 – We moved the information previously in subsection A to subsection B and retitled the subsection A “General Policy.” We incorporated information previously not included in a subsection, with minor organizational and editorial changes. We made other minor organizational and editorial changes and incorporated information previously in subsections E and F. We retitled subsection B “Administering the Oath or Affirmation” and explained what actions are needed before administering an oath or affirmation. We incorporated information previously in subsections A, B, C, and D with minor editorial changes. We then removed subsections C, D, E, and F.

I-2-6-76 – We added a reference to the applicable regulations and made other minor editorial changes to the language.
