Subject: Issues Before the Administrative Law Judge

Background

This transmittal amends section I-2-2-35 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information relating to jurisdiction over certain earnings related issues.

Explanation of Content and Changes

HALLEX I-2-2-35 was amended as follows:

I-2-2-35 – We changed the title to “Jurisdiction in Cases Involving Earnings Issues” to more accurately reflect the content of the section.

I-2-2-35 A – We retitled the subsection “Wages and Self-Employment” and retained some information previously in subsection A. We also added helpful references to other applicable instructions.

I-2-2-35 B – We incorporated some information previously in subsection A and retitled the subsection “Federal Insurance Contributions Act (FICA) Tax Liability.” We made editorial and formatting changes to the information. We also added a NOTE explaining that an administrative law judge (ALJ) may dismiss in part when the ALJ retains jurisdiction over other issues in the claim(s).
