Background

This transmittal amends section I-2-0-5 of the Hearings, Appeals and Litigation Law manual to update and clarify the responsibilities of hearing office (HO) staff.

Explanation of Content and Changes

I-2-0-5 – We revised subsection B to include reference to an administrative law judge's responsibilities when he or she provides instructions to an assisting decision writer. We also revised subsection C to add that HO staff responsibilities include notifying a claimant of the right to representation and the options for obtaining representation. In subsection C, we also reformatted the list of the responsibilities for HO staff into a bulleted list. Finally, we made formatting and minor editorial changes throughout the section.
