Subject: Conduct of Hearings

Background

This transmittal amends chapter I-2-6 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update procedures for using foreign language interpreters.

Explanation of Content and Changes

I-2-6-10 – We updated the procedures for using foreign language interpreters during hearings by clarifying that a claimant or witness need only request an interpreter or indicate a need for an interpreter, not demonstrate such a need. We updated the certification a foreign language interpreter makes at the hearing to indicate he or she will not assume or infer facts or dates nor change the original meaning of any question or answer. Additionally, we added a reference and link to instructions for reporting problems with interpretation. We also made organizational, formatting, and minor editorial changes throughout the section.

I-2-6-54 – In subsection B, we updated the procedures for administering the oath to a foreign language interpreter. We also made formatting and minor editorial changes throughout.
