Subject: Prehearing Analysis and Case Workup

Background

This transmittal amends section I-2-1-86 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update instructions regarding notifying a claimant and any representative before sending a formal request for clarification to the Appeals Council.

Explanation of Content and Changes

This transmittal revises HALLEX I-2-1-86 as follows:

I-2-1-86 – We corrected the email address for the Division of Field Procedures (DFP) in the Office of the Chilef Administrative Law Judge (OCALJ) at Section B.1. In Section B.2, we added language clarifying that the written correspondence informing the claimant and any representative of the request for Appeals Council clarification will be made using the Document Generation System (DGS) or (Hearing and Case Processing System (HACPS) letter template, as appropriate. We provided the following language to include in the written correspondence:

Pursuant to HALLEX I-1-2-86, we are writing to inform you that the Administrative Law Judge has submitted a formal request for clarification of the Remand Order issued by the Appeals Council on [DATE].

Pursuant to HALLEX I-3-9-95, if the Appeals Councl determines clarification is appropriate, the Appeals Council will mail you a copy of the order vacating its prior remand order. If the Appeals Council denies the request for clarification, the Appeals Council will send you a copy of the memorandum denying the request for clarification.
