Background
This transmittal adds section I-3-8-35 to the Hearings, Appeals and Litigation Law (HALLEX) manual to provide instructions for when a claimant dies shortly after the Appeals Council issues an unfavorable decision in a disability claim.
Explanation of Content and Changes
Section I-3-8-35 is organized as follows:
I-3-8-35 – We added a new section titled “Death of Claimant Shortly After Less Than Fully Favorable Disability Decision Issued” and incorporated information previously in HALLEX I-3-9-32.
