Subject: Initial Processing of a Request for Review

Background

This transmittal amends sections I-3-1-14 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update procedures for responding to requests for an extension of time (EOT) to submit evidence or arguments.

Explanation of Content and Changes

I-3-1-14 – We updated the second citation in Note 3 of Subsection A to HALLEX I-3-1-1 E and clarified that the section applies where there is an Extension of Time (EOT) request after an untimely filing of a request for review. In subsection B.1., we removed the requirement that designated OAO staff sign an initial notice granting an EOT request. In B.1., we also added language clarifying that if the Appeals Council determines there is no good cause to extend an EOT beyond 25 days, the notice we send will still provide 25 days to submit additional evidence or arguments. We also updated hyperlinks and made organizational and minor editorial changes throughout this section.
