Subject: Decisions
This transmittal amends Hearings, Appeals and Litigation Law (HALLEX) manual chapter I-3-8 to further update our policy in accordance with the regulatory changes at 85 FR 73138.
HALLEX I-3-8-10 – We retitled the section “Notice to Claimant When Granting Request for Review” to better align with the regulatory language in 20 CFR 404.973 and 416.1473. In subsection A, NOTE, and subsection B, we updated language to reflect when the Appeals Council is and is not required to issue a separate notice of review. In subsections A, B, and D, we replaced references to “interim notice of review” with “separate notice of review” for consistency with updates to HALLEX I-3-6. We also made minor editorial changes.
HALLEX I-3-8-12 – In subsection A, we replaced the reference to an “interim notice of review” with “separate notice of review” for consistency with updates to HALLEX I-3-6. In subsection D.2.b, we updated the language regarding the composition of the AC appearance panel for increased clarity. We also made minor editorial changes.
