Subject: Initial Processing of a Request for Review

Background

This transmittal amends section I-3-1-14 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update procedures for processing requests for an extension of time (EOT) to submit evidence or arguments submitted to the Appeals Council (AC) in support of a request for review.

Explanation of Content and Changes

I-3-1-14 – In subsection A., we removed reference to an outdated procedure in NOTE 1 and removed NOTE 2 in its entirety. We clarified that the AC will provide the claimant 25 days to submit evidence or arguments regardless of the length of time requested for an initial EOT request and will evaluate whether there is good cause to grant any subsequent EOT request. Additionally, we consolidated information previously located in subsection B.1, NOTE 2, to the discussion of AC's handling of moot EOT requests under subsection A. In subsection B.1, we updated policy to indicate that the AC's notice granting the initial EOT responds to all EOT requests received on the case through the date of the notice. With this update, we removed language referencing “redundant” EOT request throughout this section. We also made organizational, formatting, and editorial changes to improve clarity throughout this section.
