Subject: Office of Appellate Operations and Appeals Council Functions
This transmittal amends Hearings, Appeals and Litigation Law (HALLEX) manual Chapter I-3-0 to add a new section to provide instructions to the Appeals Council when it identifies medical cessation cases where benefits have not been terminated.
We added HALLEX I-3-0-86 to include the following:
I-3-0-86 A – We added a general subsection explaining when the claimant is and is not entitled to elect benefit continuation in medical cessation cases.
I-3-0-86 B – We added instructions for the Appeals Council when it identifies a case where benefits were not properly ceased.
