Background

This transmittal adds section I-3-0-40 to the Hearings, Appeals and Litigation Law (HALLEX) manual to provide information about the Office of Appellate Operations (OAO) appointed representative fee workload.

Explanation of Content and Changes

Section I-3-0-40 is organized as follows:

I-3-0-40 A – We titled the subsection “Initial Fee Petitions,” and we provide general information regarding the responsibility for handling the workload and the policy OAO staff uses when evaluating requests to charge and collect a fee.

I-3-0-40 B – We titled the subsection “Requests for Administrative Review of Authorized Fees.” In the subsection, we state the type of administrative reviews performed by OAO staff and include a HALLEX reference for more information on the policy associated with administrative reviews.

I-3-0-40 C – We titled the subsection “Miscellaneous Actions” and explain that OAO staff will handle miscellaneous requests of Appeals Council fee issues and will forward other requests to the appropriate component for action.
