If a court order requires readjudication of class claims, class claims involving the issue of disability are usually under the jurisdiction of the DDS which made the determination to be reviewed.
A court order or settlement agreement may specify a certain level of review, i.e., the administrative level at which the readjudication of class member claims will take place, or the issue involved may be appropriate for review only at a particular level.
See I-1-7-15 concerning jurisdiction questions. OHA may assume jurisdiction in certain instances, e.g., when class member claims and subsequent (current) claims are consolidated at the OHA level (see I-1-7-13).
