Subject: New Court Cases
This transmittal amends chapter I-4-1 of the Hearings, Appeals and Litigation Law (HALLEX) manual to include reference to Acquiescence Ruling (AR) 16-1(7), Boley v. Colvin.
Chapter I-4-1 is amended as follows:
I-4-1-2 – We included a reference to AR 16-1(7) in subsection C, note 1, to explain that the Appeals Council (AC) will notify a claimant residing in the 7th Circuit of the right to request judicial review under certain circumstances when the AC denies the request for review of an administrative law judge dismissal order.
I-4-1-58 – We retitled subsection C “Acquiescence Ruling (AR) 16-1(7), Boley v. Colvin” and included instructions for the documents that must be in the certified administrative record when AR 16-1(7) applies. We redesignated former subsection C as subsection D. We redesignated former subsection D as subsection E. We redesignated former subsection E as subsection F. We redesignated former subsection F as subsection G.
