Background

This transmittal amends section I-4-2-40 of the Hearings, Appeals and Litigation Law (HALLEX) manual to provide guidance for preparing a limited certified administrative record (CAR) in new court cases implicating Acquiescence Ruling (AR) 16-1(7), Boley v. Colvin.

Explanation of Content and Changes

HALLEX I-4-2-40 – We amended subsection C to add instructions for preparing a limited CAR in new court cases involving AR 16-1(7). We provided clarification on how to prepare a limited CAR and provided language to include on the certification page. We explained that a limited electronic CAR is not available for civil actions filed in a jurisdiction where electronic filing is mandatory and provided instructions on how to prepare a limited CAR for such cases. We also made minor editorial changes to the other subsections to improve readability.
