Background

This transmittal amends Hearings, Appeals and Litigation Law (HALLEX) manual chapter I-5-3 to remove temporary instructions for the elimination of the Decision Review Board and related references to the regulations in 20 CFR Part 405 based on the final rule published in the Federal Register at 81 FR 90987. This new rule establishes nationally consistent procedures for case processing and removes the existing regulations in 20 CFR Part 405.

Explanation of Content and Changes

HALLEX I-5-3-18 – We remove the temporary instruction in its entirety because the information is superseded by the new final rule.

HALLEX I-5-3-20 – We remove a reference to the regulations in 20 CFR Part 405. In addition, we correct the citation to Social Security Ruling 13-3p. We also made minor editorial changes.
