Subject: Disability Matters
This transmittal updates section II-5-3-1 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update guidance on evaluating good cause for failure to follow prescribed treatment in the context of psychiatric impairments.
II-5-3-1 – We retitled the section replacing “good reason” with “good cause” for consistency with Social Security Ruling 18-3p. Throughout the section, we updated the language and citations to make it consistent with SSR 18-3p, including removal of the final two sentences of the second paragraph of the discussion. We updated the reference to HALLEX I-2- 5-34 to clarify that the referenced information appears in subsection A.2. We also made minor editorial changes.
