Annual Data for Pre-effectuation Review (PER) of Disability Determinations

Public Law 96-265, Public Health and Welfare, Section 221-c, requires us to review at least 50 percent of all Social Security Title II disability and concurrent Title II/Title XVI disability (SSI/DI) favorable initial and reconsideration determinations made by the State Disability Determination Services (DDS). In addition, Public Law 109-171, Deficit Reduction Act, requires we review at least 50 percent of all SSI adult initial and reconsideration favorable determinations made by the State DDSs.

We select Pre-effectuation Review (PER) cases from 52 DDSs (the 50 States, District of Columbia, and DI cases from the Commonwealth of Puerto Rico) using a statistical model to identify allowances with a high probability of containing substantive errors (i.e., potential to ultimately reverse the determination from allowance to denial).

The dataset contains annual, national level data for fiscal years (FY) 2012 - 2016. The agency submits an annual report to Congress about the results of the PER. The PER reports contain the data included in this dataset as well as additional information about the cost effectiveness of the review. Program information and more detailed information describing the data is also included in the PER reports (links to the PDFs are provided above).
