Subject: Prehearing Analysis and Case Workup
Background
This transmittal revises section HA 01210.055 of the Hearings, Appeals, and Litigation Law (HALLEX) manual to update and clarify when a case may be reassigned to a different administrative law judge (ALJ).
Explanation of Content and Changes
This transmittal revises HALLEX HA 01210.055 as follows:
01210.055 – We updated references to obsolete titles and systems throughout the section.
01210.055F – We updated the language in the subsection's introductory text to clarify that a case may be reassigned to avoid a detriment to the public. In F.1, we removed examples of when a case may be reassigned before an ALJ hearing has been held. In F.2, we clarified that in situations where a hearing has already been held, a management ALJ may reassign a case to another ALJ with concurrence of the Head of the Hearings Hub, Associate ALJ, Chief ALJ, or, for the Special Review Cadre, the Executive Director of Disability Compliance. We also added examples of situations that constitute a detriment to the public.
