Subject: Administrative Law Judge Decisions
Background
This transmittal amends subchapter 01280 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update the requirements for Decision Writing Instructions.
Explanation of Content and Changes
HA 01280.020 – We revised the section to clarify the requirements for Administrative Law Judge (ALJ) decision writing instructions. We added language in subsection A to emphasize the ALJ's responsibility in each case. We also expanded the requirements in subsection B to include addressing evidence submitted within five days of the hearing, evaluation of Vocational Expert evidence consistent with Social Security Ruling 24-3p, and responding to Appeals Council or federal court instructions. We revised subsection C to include additional things ALJs should avoid when providing instructions. We also made editorial changes to improve clarity and conciseness throughout this section.
