Subject: Prehearing Analysis and Case Workup
This transmittal amends section I-2-1-60 of the Hearings, Appeals and Litigation Law (HALLEX) manual to clarify procedures relating to administrative law judge (ALJ) disqualifications.
HALLEX I-2-1-60 C is amended to clarify that an ALJ may obtain any needed information and set forth his or her decision regarding disqualification on the record during the hearing if there is insufficient time before the hearing for the ALJ: (1) to respond in writing to a claimant's objection to the ALJ; or (2) to obtain information necessary to decide a disqualification issue. We also inserted a missing hyperlink and title to a Social Security Ruling.
