Subject: Scheduling and Notice of Hearing
This transmittal amends section I-2-3-25 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information regarding a claimant?s waiver of advance notice of a hearing.
We amended HALLEX I-2-3-25 by incorporating applicable regulatory and HALLEX citations. We made editorial changes and reorganized the information. We also clarified that a claimant may submit a waiver of advance notice at any time before or at the hearing, but that an ALJ must obtain such a waiver in writing before going on the record.
