Chapter: I-2-100 and I-2-600
Subject: Prehearing Analysis and Case Workup, and Conduct of Hearings
Section 206(a) of Pub. L. No. 103-296, the Social Security Independence and Program Improvements Act of 1994, enacted August 15, 1994, contains provisions for the prevention of fraud by translators of foreign languages. The revisions to Chapters I-2-100 and I-2-600, reflected in this transmittal, include revisions based on the provisions in section 206(a) of Pub. L. No. 103-296.
In Chapter I-2-100, we revised:
Section I-2-170, Foreign Language Interpreters, to include criteria for a qualified foreign language interpreter and sources of qualified foreign language interpreters.
In Chapter I-2-600, we revised:
Section I-2-610, Hearing Procedures — Foreign Language Interpreters, to include the requirement that a third party foreign language interpreter certify, under penalty of perjury, his or her relationship to the person testifying, including whether he or she is acting as the person's legal representative, and the accuracy of his or her translation; and
Section I-2-654, Oaths and Affirmations, to include information about the certification requirements for an interpreter, a cross-reference to section I-2-610, and “under penalty of perjury” language in the oath or affirmation for an interpreter.
We also made editorial changes in the above sections and in sections I-2-172, Interpreters — Hearing-impaired Claimant, and I-2-612, Hearing Procedures — Hearing-impaired Claimant, for purposes of clarity and consistency.
