Background

This transmittal amends section I-3-3-15 of the Hearings, Appeals and Litigation Law (HALLEX) manual to include reference to Acquiescence Ruling (AR) 16-1(7), Boley v. Colvin.

Explanation of Content and Changes

HALLEX I-3-3-15 provides instructions about filing requirements when an administrative law judge (ALJ) dismisses a request for hearing because the claimant did not timely file the request for hearing. We added a note to subsection A regarding AR 16-1(7), Boley v. Colvin. Under AR 16-1(7), a claimant in the 7th Circuit may obtain judicial review of an ALJ's dismissal order finding no good cause for a late hearing request under certain circumstances.
