Background

This transmittal amends chapter I-3-4 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update information relating to Appeals Council dismissals.

Explanation of Content and Changes

HALLEX I-3-4 is amended as follows:

I-3-4-20 – In subsection A, we explained in more detail the circumstances in which the Appeals Council may dismiss a request for hearing. We made editorial and formatting changes. We changed the title of subsection B to “Procedures,” added helpful citations to other HALLEX instructions, incorporated information previously in subsection D and HALLEX I-3-4-40, and made editorial and formatting changes. We removed subsection C in its entirety because the information was unnecessary and duplicative of HALLEX I-3-2-5. We removed subsection D in its entirety because the information that was not outdated was incorporated in subsection B.

I-3-4-40 – We moved information that was not outdated to HALLEX I-3-4-20 and deleted the section in its entirety.

I-3-4-50 – We added helpful regulatory and acquiescence ruling citations and language. We made other organizational and editorial changes.
