Subject: Fraud, Similar Fault, and Administrative Sanctions
This transmittal updates Chapter I-3-10 to memorialize existing Appeals Council (AC) level guidance and procedures for adjudication of cases when a claimant or appointed representative alleges fraud or similar fault was involved in the providing of evidence.
I-3-10-1 – In subsection A, we added a cross-reference to I-3-10-12 when evaluating allegations of fraud or similar fault reported by the claimant or representative. In subsection B, we added a cross-reference to the new section I-2-10-12.
I-3-10-12 – We created a new section titled “Evaluating Allegations of Fraud or Similar Fault by the Claimant or Representative.” This new section provides Office of Appellate Operations staff and AC adjudicators instructions for addressing allegations of fraud or similar fault.
