Chapter 6-20 of the Appeals Text Guide contains shells and stored paragraphs to use in preparing remand orders, both in request for review and own motion review cases.

The remand order for further action in abandonment cases (REM 10) has been modified to reflect the AC's policy as expressed in the Deputy Chairman's memo of January 5, 183. REM 11 is a new format for (1) vacating dismissals which were based on reasons other than abandonment, and (2) remanding for further proceedings.

The optional “pain” paragraphs in the general purpose/medical development remands (REM 21 - REM 23) have been revised to reflect the statutory provisions on evaluation of pain as contained in the Social Security Disability Benefit Reform Act of 1984.

Section 6-20-29 contains six stored paragraphs to fit six different medical development situations which may be required on remand, plus another paragraph for cases in which VE testimony may be needed after medical development. Any of these seven paragraphs may be used in either request for review or own motion cases.

For cases remanded to obtain VE testimony, there are now six stored paragraphs to cover six different situations in which VE testimony is needed in request for review cases and five for own motion cases (6-20-39).

The miscellaneous remands in 6-20-40ff include a new format (REM 43) for a short-form remand when the claimant has been offered and elects further consideration by an ALJ.

As with all other transmittals for Part 6, the entire remand text should be reviewed before attempting to use it for the first time. Any errors detected or problems encountered in using this material should be brought to the attention of the Branch Chief promptly so that corrective action, where necessary, can be taken.

Action Note

When notified, begin using the transmitted material and discard:

(1) in Part 5,

(2) in the existing standardized text, all material relating to remand orders.
