Background

This transmittal amends section I-4-5-5 of the Hearings, Appeals and Litigation Law (HALLEX) manual to update procedures for processing a request for voluntary remand of a partially favorable decision.

Explanation of Content and Changes

I-4-5-5 – We amended this section to add a note providing that when analyzing a request for voluntary remand of a partially favorable decision, review is limited to the unfavorable portion of the decision. We also specify that while the favorable portion is not before the Appeals Council, the entire decision is subject to the reopening regulations.
