Subject: Redeterminations Under Sections 205(u) and 1631(e)(7) of the Social Security Act

Background

This transmittal removes section I-5-6-2A and I-5-6-3A of the Hearings, Appeals, and Litigation Law (HALLEX) manual in their entirety because they contain instructions that have become obsolete.

Explanation of Content and Changes

I-5-6-2A – We removed this section, entitled “Huntington, West Virginia (Pending Cases),” because we determined there are no cases currently with the agency to process under these instructions. These instructions pertained only to claimants identified in the Social Security Administration's Office of the Inspector General 1129(l) referral involving fraud or similar fault in the Huntington, West Virginia hearing office, who had a case pending a final determination or decision at the time of the referral, i.e., their case was not subject to redetermination.

I-5-6-3A – We removed this section, entitled “New York (Pending Cases),” because we determined there are no cases currently with the agency to process under these instructions. These instructions pertained only to claimants who were not indicted, but who were individually referred to SSA by the New York County District Attorney's Office (DA) in a referral letter dated February 25, 2014, and who had a case pending a final determination or decision at the time of the referral, i.e., their case was not subject to redetermination.
